Severed Fingers Results in Two Firms Being Prosecuted
Posted by David Cant on June 27, 2011

Are your Machines Properly Guarded?

Health and Safety Consultants will be able to tell you the importance of making sure that you have health and safety procedures and policies in place.  The reason for this is to primarily ensure that you are providing a safe working environment.  Failure to do so mean that you are in breach of the Health and Safety at Work Act 1974, and perhaps are breaking other laws associated with your industry.

Health and Safety Services are there to Help Avoid Accidents

Machinery is one of the areas which need to be vigilantly monitored to ensure that any procedures and safety measures are constant.  One lapse could result in death and serious injury.  Health and safety services can help businesses to keep on top of the regulations and train the workers to help them carry out their work in a safe manner.

One Simple Action is all it takes

A lapse occurred in Worcestershire when an employee severely injured his fingers while working on a carding machine. While operating the carding machine, the worker was watching to make sure that the polypropylene fibres which are forced into a sock made of nylon was working as expected. The nylon sock is then used to help absorb unwanted chemicals and oil in spills.

Unfortunately there was a blockage of fibres which had attached themselves to the teeth of the rollers.  While doing so his fingers got trapped in the nip of the rollers which left his index finger, middle finger and his thumb severed.

Investigation Showed Poor Health and Safety

After the incident the Health and Safety Executive investigated and discovered that KSR UK Ltd had not guarded the machine.  This is a long standing guide which states that carding machines need a guard to make sure that it is not interfered with while it is on.

They also found that the second company, Non-Flam Co Ltd had not made risk assessments which are offered by health and safety consultants. The Workplace risk assessment would have identified the hazards to the workers. These hazards would have then been addressed.

The two firms have the same directors and are situated next to each other at Tardebigge in Bromsgrove.  The firms were prosecuted separately which resulted in two fines. The court in Redditch heard Non-Flam CO Ltd plead guilty to breaching section 2(1) of the HSE at Work Act. They were fined £1,000 and had to pay £8,000 in costs.

KSR UK Ltd also pleading guilty for breaching one of the regulations of the Provision and Use of Work Equipment Regulations which were created in 1988. They also had costs of £8,000 and were fined £3,000.

Completely Avoidable and Inexcusable

If a risk assessment had been carried out the hazard of using the machine without a card could have been addressed.  Health and safety consultants are there to give you advice.  There are numerous health and safety services which can protect your employees and the public from harm caused by your company.
